The Debt Collection Improvement Act of 1996 (DCIA) centralized the government-wide collection of delinquent federal non-tax debt and gave the U.S. Department of the Treasury’s Bureau of Fiscal Service the power and responsibility to implement the debt collection provisions of the DCIA on behalf of federal agencies such as the U.S. Department of Housing & Urban Development (HUD), the U.S. Department of Education, and the Defense Finance & Accounting Service (DFAS).

Administrative Wage Garnishment (AWG)

The DCIA authorizes Fiscal Service to initiate Administrative Wage Garnishment (AWG) proceedings against employee paychecks. If you receive a Notice of Intent to initiate AWG from Treasury’s Fiscal Service or from a Private Collection Agency, you only have twenty-one (21) days to submit a Request for Hearing, along with your documentary evidence supporting your positions. You can request a hearing if you can prove that you do not owe the debt, disagree with the amount the government claims you owe, or if the proposed garnishment would cause you financial hardship.

These affirmative defenses are not easy to prove by yourself – especially if you are only given a couple of weeks to respond to the Notice of Intent. The DCIA also requires federal agencies to refer delinquent non-tax debts to Fiscal Service for collection by offset of non-tax payments. Non-tax payments include federal vendor, federal retirement, federal salary, and Social Security benefits. For each of these proposed offsets, you may submit a request for administrative review to challenge Fiscal Service’s actions. Again, you will need to provide documentary evidence to support each of your arguments challenging the government’s proposed offset.
